-Did the Supreme Court Just Allow Same-Sex Marriage to Become the Law of the Land?

Did the Supreme Court of the United States just allow same-sex marriage to become the law of the land by declining to take on appeals from 5 states?

Many believe by their inaction that the court at the very least has allowed homosexual marriage to gain a legal momentum that would seem to be nearly impossible to stop.

With the court declining to act on the 5 state cases yesterday, same-sex marriage is now legal in 30 states and the District of Columbia. The battle would seem to be all but over.

Actually last years 5-4 decision by the court to strike down DOMA (Defense of Marriage Act) was far more instructive and directly lead to the 5 lower court decisions that were up on appeal. The courts refusal to take up these cases does nothing more than to continue and further that major decision. It is nearly impossible to see any way that the court can back away from that now and support traditional marriage. I remarked at the time that the DOMA ruling would eventually lead to same-sex marriage becoming the law of the land. The non-action by the court yesterday adds support to that view.            *Top
