-US Supreme Court Questions Legality of President Obama’s Recess Appointments

In a case involving A decision by the National Labor Relations Board, the SCOTUS is finally looking into the legality of several recess appointments made to the board by President Obama. From the Citizen Link:

U.S. Supreme Court justices on Monday sounded skeptical concerning President Obama’s recess appointments.

The president made the four appointments — which included filling three vacancies on the National Labor Relations Board (NLRB) — on Jan. 4, 2012. The problem: The Senate was in session.

The case involves Noel Canning, a bottling company in Washington state, and a local Teamsters union. The NLRB favored the union. Noel Canning then filed suit, arguing that the decision was invalid because Obama’s recess appointments to the labor board violated the Constitution.

Response: It is good to see some of the blatant acts of disregard for the law and the Constitution by this president finally being challenged. It will be interesting to see how the court rules on this and especially what some of the more liberal justices will choose to do in this case.

Remarkably the Democratic ruled Senate refused to challenge the legality of President Obama’s recess appointments even though it was a direct challenge to the Senate’s Constitutional power. Probably because the Republican Senators were blocking the appointments but nevertheless it set a lawless unconstitutional precedent in the name of politics.

The fact that SCOTUS is looking at this gives one hope that other Constitutional challenges that this President has made like those against religious freedom and conscience might eventually be addressed and resolved. If the president is found to have violated the Constitution in this case it will increase the possibility that some of his other policies will be successfully challenged.             *Top
