-California: Students Can Now Go into Bathroom and Locker Room of Choice?

It was billed as a law to allow ‘transgender’ children to choose the gender of their choice on any given day in California public schools.

The reality is that boys can now choose to invade the girls restrooms or locker rooms on any given day by merely declaring themselves to be ‘female oriented’ on that occasion. The bill also allows students to choose which athletic teams that they would like to be on. Boys can now choose to compete on girls teams in California and visa versa.

What we are talking about is a new law signed into existence for the new school year by California Gov. Jerry ‘Moonbeam’ Brown. We have been following this story for months now as the bill worked it’s way through the California legislature and now with one stoke of the pen it is law regardless of what the majority of parents in California may think about it. Here’s the story from OneNewsNow:

Without comment, California Governor Jerry Brown yesterday signed into law a bill (AB 1266) strengthening the rights of transgender students (K-12) in the state’s public schools. It makes the Golden State the first state in the nation to allow participation in “sex-segregated programs, activities, and facilities” in public schools based on a student’s gender identity.

Under the new law, public schools will be required to allow the students access to whichever restroom and locker room they want – and it would allow boys to take showers with girls just because they say they feel they are female.  …

Brad Dacus of the Pacific Justice Institute is among those reacting strongly to Brown’s signing of the measure.

“It’s an outrageous and egregious violation of the privacy and decency for young women and young girls all throughout the state of California,” the attorney tells OneNewsNow. “This new law will even allow boys to play on girl’s athletic teams. So this is a serious violation of the fundamental right of young people up and down the state of California.”

Response: So let me get this straight. Students in California public schools are now able to arbitrary choose for themselves from day to day what gender they want to be and their parents don’t even have to be aware of it? Then on that self-proclaimed basis could have access to bathrooms and locker rooms of the opposite sex and even join any sports team regardless of actual physical gender?

The new law is designed to help the 1 tenth of one percent of students that may be ‘transgender’ or have gender identity issues. However 99.9% of the student could be affected by the new law since there are no provisions or guidelines to determine whether a student is truly ‘transgender’ or just faking it to gain greater access to the opposite sex. No parental approval or notification is needed nor a letter from a professional counselor or psychologist. It is completely left up to the students to choose for themselves on any given day. The possibilities for obvious abuse are legion. I would not want to be a teacher or a school administrator under these conditions and lack of provisions.

Now if a boy would like to take a shower with his girlfriend there is nothing but common sense standing in the way? Also, if a high school boy doesn’t make the boy’s basketball team he could always try out for the girl’s team and have the added possibility of sharing the locker room and showers with his new team mates of the opposite sex?

Is the world going insane. They do not call this one-party rule mecca of progressive experiments- LA-LA Land for nothing. But don’t laugh, the next stop could be your state. Look for ‘homeschooling’ to grow exponentially in this coming school year in California.            *Top

Here is the relevant portion of the new law’s text.

    (e) Participation in a particular physical education activity or sport, if required of pupils of one sex, shall be available to pupils of each sex.
    (f) A pupil shall be permitted to participate in sex-segregated school programs and activities, including athletic teams and competitions, and use facilities consistent with his or her gender identity, irrespective of the gender listed on the pupil’s records.

It is actually worse in its impact than most commentators have yet grasped. If a school group goes on a field trip involving an overnight stay, as I read the law, the school would NOT be able to assign students to sexually segregated sleeping quarters, but would have to allow any student who demanded it the opportunity to sleep in quarters with students of the opposite biological gender.

Further, most public schools now have sex education, and most sex education classes are sexually segregated (at least for some lectures)- so what happens when a biological male says “I want to be in the girl’s sex education class”?

Finally, assume you have a 12-year-old daughter who is going to be in P.E. this year, with a self-identified transgendered 12-year-old male in her class, in her dressing room, and in her shower. Would you permit it? Would the other 30-40 parents of 12-year-old girls stand for it? So, you ask to have your daughter reassigned to another class – – so does every other parent in her P.E. class. Do you think the school, in light of this statute, can allow your daughter, or the other girls in her class, to transfer out? I believe that you are going to see attempts made by parents to get students out of classes (especially P.E.) in which transgendered students are enrolled, but that the districts, in light of the statute’s goals, are going to have to refuse such transfers. Then what do you do?

Doesn’t bother me, many parts of the world have unisex bathrooms. It’s just a cultural convention at issue.

  3. Brian

Mark – This act goes far far beyond unisex bathrooms!

Thanks Brian for your comments. I don’t think anyone at this point can really know all of the possible problems and lawsuits that will be generated by this law.
