-School Ban on Christmas Carols Upheld?

The U.S. Supreme Court declined on Monday (Oct. 4) to hear an appeal of a school ban on religious holiday music by a New Jersey school district.

This ends a six year legal struggle started by a parent -Michael Stratechuk who sued the School District of South Orange and Maplewood over their policy barring religious songs at school concerts including Christmas carols and even instrumental music that is performed without the words.

In addition, the policy also prohibits "any printed programs for any holiday concert to have any graphics which refer to the holidays, such as Christmas trees and dreidels."

The 3rd U.S. Circuit Court of Appeals upheld the school district’s ban last year. The refusal of the Supreme Court to consider the case leaves the 3rd Circuit’s ruling in place and may end up affecting more than just one school district in New Jersey but could have unforeseen consequences all across the country.

Response: By default this ruling establishes a new legal standard that school districts throughout the whole country might have to pay attention to. Particularly if an atheist organization or parent demands that the local district follow suit.

How can you have a ‘holiday’ concert without the holiday music or a holiday celebration without any decorations?

It really could be the death of those wonderful ‘holiday’ concerts that I so fondly remember as a child and as a parent. It is really hard for me to understand that some how years ago when we were singing Christmas carols and Hanukkah songs we were really breaking the first amendment?
