-Supreme Court: Mojave Memorial Cross Can Stay

The US Supreme Court ruled on Wednesday that the Mojave Desert memorial cross can stay. The cross has been covered since 2002. In a 5-4 vote the justices said:

“the constitution does not oblige government to avoid any public acknowledgment of religion’s role in society.”

They also said that the lower courts did not give enough importance to the transfer of the property to the VFW who had erected the Memorial in the first place in 1934 to those who died WWI.

In 2004, Congress voted and authorized the transfer of the one acre of land under the cross to the Veterans of Foreign Wars in exchange for five acres of land elsewhere. This should have ended the controversy but the legal cases continued in spite of it and actually blocked the transfer.

Response: This case demonstrated that those who were trying to get the cross removed from public lands were not really concerned about the ‘separation of church and state’ issue but were really all about removing religion entirely from the public square. The Congress had voted to transfer the land to private ownership and that should have ended the case.

The transfer can now go through and the cross will be on private land owned by the organization that erected the memorial. This decision should end the controversy and satisfy everyone concerned about the ‘separation’ clause except radical atheists and secularists who are really trying to eliminate religion entirely.             *Top
