-Gay ‘Hate Crimes’ Bill Coming up for Vote

by Dr. D ~ April 20th, 2009

1ano8 U.S. Representative, Barney Frank, announced last Thursday that the House Judiciary Committee will be considering hate crimes legislation, H.R. 1913, this week. Now we know that the actual committee vote will be on Wednesday April 22.

Frank is expecting the committee to pass the bill then it will be up for consideration and a vote before the whole Congress. Folks this thing is on the fast track and will probably be voted on before the end of the month if Rep. Frank gets his wish.

President Obama has already pledged to sign the bill if it comes before him. Pres. Bush vetoed a similar bill several years ago.

WHAT THE BILL DOES:
The Local Law Enforcement Hate Crimes Prevention Act, H.R. 1913, would:

  • Extend existing federal protections to include “gender identity, sexual orientation, gender and disability”
  • Allow the Justice Department to assist in hate crime investigations at the local level when local law enforcement is unable or unwilling to fully address these crimes
  • Mandate that the FBI begin tracking hate crimes based on actual or perceived gender identity
  • Remove limitations that narrowly define hate crimes to violence committed while a person is accessing a federally protected activity, such as voting.

Response: What ever happened to equal protection under the law? What this bill actually does is gives ‘special rights’ for the first time to “gender identity, sexual orientation” so that any violence against homosexual or transgender folks will carry additional penalties in addition to the laws already on the books.

It also provides the Federal government with power to step in if they deem that local officials are not enforcing the law properly.

Notice also that the definition of ‘Hate Crimes’ is expanded and not limited to violence for those involved in some kind of “federally protected activity”. This is a dangerous open-ended loop-hole that could be interpreted by judges to include all sorts of un-told activities. What is a “federally protected activity”? Also, what kind of activities might be construed to be a ‘Hate Crime’ under this provision? No one really knows at this juncture.

There are all sorts of Christian organizations and websites out there proclaiming that the bill will end up with Pastors being arrested for teaching or preaching on homosexuality from a Biblical perspective. I don’t personally see that happening from this bill—but who is to say how the “federally protected activity” provision will be interpreted by liberal activist judges?

This bill needs to be defeated or at the very least amended to clear up the fuzzy areas. This thing is coming on fast and time is short—contact your Representatives quickly!       *Top
