-Judge Declares US Gay Marriage Ban Unconstitutional

On Thursday, a federal district court judge in Boston struck down the 1996 federal law that defined marriage as a union between a man and a woman.

The law stood in the way of gay marriages being recognized nationally.

Judge Joseph L. Tauro ruled that the federal Defense of Marriage Act (DOMA) violated the Constitutional rights of same-sex couples to equal protection under the law and that states were free to pass their own marriage laws:

“…this court is convinced that the federal government’s long history of acquiescence in this arena indicates that, indeed, the federal government traditionally regarded marital status determinations as the exclusive province of state government.”

Response: I can’t imagine any of the original framers of the Constitution supporting this decision. Fact is, in every single case same-sex marriage has been forced upon the states through the courts and run away legislators who were governing against the will of the people. Every time any same-sex marriage proposal has come up for a vote it has been turned away by a substantial margin.

This is another case of judicial fascism where laws are created and passed by judicial fiat. Gay marriage was forced upon Massachusetts by judicial decree in the first place and now it becomes a major an excuse for changing enacted federal law?

Nevertheless this is a major victory for the Gay rights activists. DOMA was a major block to the rest of the nation coming on-board with same -sex marriage.  Unless this is effectively appealed than homosexual marriage will become a fait accompli across the country.  Some states in the South may hold out but nationally it will become law.

If this domino falls than churches and religious organizations will be under increasing cultural and legal pressure to recognize gay marriages and relationships. Even if their teaching and theology continue to oppose it .

The Obama administration is sympathetic to the gay cause so may not appeal this decision. If not, then there will be ‘heck’ to pay in November. Folks all across this great nation are getting sick and tired of being ruled and over-ruled by judges and politicians who are running things against the expressed will of the voters. A day of reckoning is coming on election day in November. Just wait and see.            *Top of the Blog
